1. Introduction

This Privacy Policy describes how Soundyaad Digital Ltd ("Soundyaad," "we," "our," or "us") collects, uses, discloses, and safeguards personal information when you or your fans use the Soundyaad platform and related services (the "Platform").

Soundyaad is the release operating system for independent African artists, helping you build your fanbase, own your audience, and grow your career. We comply with the Nigeria Data Protection Act (NDPA) 2023. The Platform is intended for users in Nigeria and other supported markets and is not directed at residents of the European Economic Area or the United Kingdom.

2. Information We Collect

2.1 Information You Provide

  • Account Information: Name, email address, phone number, and profile details when you create an account
  • Artist Information: Artist name, bio, social media links, and music release details
  • Payment Information: Billing details processed through our third-party payment providers (currently Flutterwave for card and bank payments and NOWPayments for cryptocurrency). Full card details are handled by those providers; Soundyaad only receives non-sensitive transaction metadata such as the last-four digits, amount, and status.
  • Communications: Messages and inquiries you send us

2.2 Information Collected Automatically

  • Usage Data: Pages visited, features used, and interactions with our platform
  • Device Information: Browser type, operating system, and device identifiers
  • Analytics: Aggregate data about how users interact with your release pages and bio sites

2.3 Fan Data Collection

When fans interact with your pre-save pages, smart links, or bio sites, we may collect their email addresses, phone numbers, and engagement events with their explicit consent.

Roles under data-protection law: With respect to fan data you collect through your Soundyaad pages, you (the artist) act as the data controller and determine the purposes for which that data is processed (e.g. marketing your music). Soundyaad acts as your data processor, storing and processing fan data on your behalf solely to provide the services you have configured. You are responsible for obtaining any consents required by law, responding to fan data-subject requests (access, deletion, etc.), and using fan data lawfully. Soundyaad will assist you with those obligations where reasonably required.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our services
  • Process transactions and send related notifications
  • Send you marketing communications (with your consent)
  • Respond to your inquiries and provide customer support
  • Monitor and analyze usage patterns to improve user experience
  • Detect, prevent, and address technical issues or fraud

4. Information Sharing & Sub-processors

We do not sell your personal information. We may share your information with:

  • Music Platforms: When you create pre-saves or smart links, we interact with Spotify, Apple Music, Audiomack, Boomplay, YouTube Music, Deezer, Tidal, and similar streaming services on your behalf.
  • Legal Requirements: When required by law, legal process, or to protect the rights, property, or safety of Soundyaad, our users, or others.
  • Business Transfers: In connection with a merger, acquisition, or sale of all or part of our business, subject to equivalent privacy protections.

4.1 Sub-processors

We engage the following sub-processors to operate the Platform. Each is bound by contractual obligations to process personal data only on our instructions and to maintain appropriate security.

  • Supabase — managed database, authentication, and file storage.
  • Vercel — application hosting, edge delivery, and product analytics.
  • Sentry — error monitoring and performance diagnostics.
  • Flutterwave — card, bank, and mobile-money payment processing.
  • NOWPayments — cryptocurrency payment processing.
  • Google Tag Manager / Google Analytics — website analytics and tag orchestration.
  • Transactional email providers — for account, billing, and release-related emails.

We will update this list as our sub-processors change. Material changes will be communicated to you per Section 10.

5. Data Security

We implement appropriate technical and organizational measures to protect your personal information. This includes encryption, secure servers, and regular security assessments. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

6. Your Rights

Subject to applicable law (including the Nigeria Data Protection Act 2023), you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate data
  • Request deletion of your personal information ("right to erasure")
  • Export your data in a portable format
  • Object to or restrict certain processing
  • Opt-out of marketing communications at any time
  • Withdraw consent where processing is based on consent, without affecting the lawfulness of prior processing
  • Lodge a complaint with the Nigeria Data Protection Commission (NDPC)

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. We may retain certain information as required by law or for legitimate business purposes.

8. International Data Transfers

Because our sub-processors operate globally, your information may be transferred to and processed in countries other than your country of residence, including the United States. Where required by law we rely on recognised transfer mechanisms and safeguards under the NDPA.

9. Children's Privacy

Our services are not intended for individuals under 16 years of age. We do not knowingly collect personal information from children.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on this page and updating the "Last updated" date.
